An employee who was led astray by a Workers’ Compensation Claims Information Help Line representative can use testimony about the mistake to help him toll the statute of limitations on his benefits claim, the Commonwealth Court has ruled.
The three-judge panel said it was not the employee’s fault he sent his claim petition late because the help-line employee told him the wrong deadline.
