A split state Supreme Court has allowed an employer to recoup part of a $140,000 benefit payment because the claimant kept a portion of the money for himself.

The majority said the employer was duped into paying more than the actual amount of the medical bills, but the dissenters countered that the employee was entitled to the money because he persuaded the hospital to accept a lower payment on his bills.
