The state is liable for the drowning of a 2-year-old child at her fosterparents’ home, lawyers for the girl’s natural family told the GeorgiaSupreme Court Monday.

At issue in the case is not just the child’s death but whether the stateis protected from some claims under an exemption clause of the GeorgiaTort Claims Act.
