Few Texas lawyers will be able to escape the reach of the state Supreme Court's July 1 holding in Burrow v. Arce. A unanimous court held that lawyers can now be required to forfeit some or all of their fees for breaching their fiduciary duty of loyalty to clients, even when clients aren't damaged by the breach. Plaintiffs lawyers, especially those who win a big pay day in a personal-injury suit, are prime targets of the new fee forfeiture rule, according to malpractice specialists.
