Some 15 years ago, my colleague Silas Wasserstrom wrote one of those law review articles whose title tells it all: "The Incredible Shrinking Fourth Amendment." Since then, the amendment has shrunk further and further. This year was no exception, as the Supreme Court continued its campaign to eviscerate Fourth Amendment (and other criminal defendant) protections. There's not much there there anymore, but whatever there is, it's still shrinking.
