Taking up a case that challenged a law enacted in 1995, the Ninth Circuit U.S. Court of Appeals on Friday reached the curious conclusion that the issue was decided 26 years ago.
But even so, the bare majority of an en banc court took a shot at Congress for meddling in judicial oversight of prison litigation.
