Pretrial jury instructions and a glossary for the jury were two tactical tools credited by plaintiff’s counsel with winning an $8.1 million patent infringement trial in Texas earlier this month.

The case, MessagePhone Inc. v. SVI Systems Inc., CA No. 3:97-CV-1813-H (N.D. Texas), ended on June 9, when presiding judge Barefoot Sanders ordered SVI Systems to pay treble the jury award of $2.65 million, plus attorney fees, to MessagePhone, according to court documents.
