Eight of the nine miners trapped underground in 2002 when a Pennsylvania mineshaft flooded can continue their suit against the firm that controlled the mine, a state court judge has ruled. Six other miners who narrowly escaped being trapped may also continue with their claims against PBS Coals, the judge found. The company had argued unsuccessfully that flooding was an occupational hazard, and alternatively that it was the miners' employer and thus was immune under state workers' compensation law.
