The court of appeals affirmed an order of the district court. The court held that a pretrial detention order denying bail properly considered the threat that a defendant posed to a foreign community where he was charged under American law with providing material support to further commission of terrorist activities in the Philippines, the effect of which occurred abroad.

Rahmat Abd Hir, an American citizen, was charged with conspiring to provide, and providing, material support to terrorists, and contributing goods and services to a specially designated global terrorist. Abd Hir had no criminal record and no history of substance abuse.
