The day before a child killer was to die, a federal judge on Wednesday granted a stay of execution pending a U.S. Supreme Court decision on how lethal injections are conducted.
The stay of Mark Dean Schwab’s execution had been widely expected. Although the cases the high court is considering involve Kentucky’s execution method, Florida uses the same three-drug combination and Schwab’s appeal claims the chemicals violate the Eighth Amendment ban on cruel and unusual punishment.
