Former Attorney General Alberto Gonzales has retained White & Case partner George Terwilliger III. He will assist Gonzales as the Department of Justice’s inspector general, Glenn Fine, continues to investigate him for last year’s U.S. attorney firings and other matters, including allegations that he lied to Congress about the administration’s warrantless domestic surveillance program. Though Terwilliger would not give any specifics, he told Legal Times, “The nature of the representation is quite typical of the circumstances where lawyers assist their clients in dealing with government investigations and inquiries .�.�. and involves those things which concern responding to government requests.” The hiring of Terwilliger was first reported by Newsweek. Terwilliger is a white-collar criminal defense attorney in White & Case’s D.C. office. He served as deputy attorney general under President George H.W. Bush and was considered by the White House as a potential replacement for Gonzales. Abbe Lowell, head of McDermott Will & Emery’s white-collar practice, describes Terwilliger as “somebody who knows the law, knows how the Justice Department works, has a good reputation among both prosecutors and legislators.” Most significantly, says Lowell, Terwilliger is “someone who the client will listen to,” even when the client is the former attorney general. Former Deputy Attorney General Paul McNulty declined to comment on whether he has hired outside counsel, but he did say that he has not heard from DOJ investigators since stepping down in August.
