The American Civil Liberties Union again pleaded with the Foreign Intelligence Surveillance Court to hand over records discussing the scope of the domestic wiretapping program on Sept. 14, arguing that the government’s efforts to keep data under wraps amounted to “a proposal that this Court should sanction the development of a body of secret law.” In its reply to the government’s August filing, which contended that the court had neither the jurisdiction nor the authority to unseal the records, the ACLU argued that every court has the authority to supervise its own docket and that the court is obligated to consider whether the records are properly sealed. U.S. District Judge Colleen Kollar-Kotelly, who presides over the spy court, will have the final say in the matter.
