Connecticut legal scholars are aghast at assertions made by Stamford, Conn., Superior Court Judge John Redmond Downey that undocumented aliens don't have the same rights in the court system as U.S. citizens. According to court transcripts, Downey declared in a wrongful death proceeding, "I think citizens and people here validly have a right to use the court system and those who are here illegally do not." Last week, Connecticut Gov. M. Jodi Rell withdrew her nomination of Downey to the Appellate Court.

Connecticut legal scholars are aghast at assertions made by Stamford, Conn., Superior Court Judge John Redmond Downey that undocumented aliens don’t have the same rights in the court system as U.S. citizens.
It’s not up to Downey, or any other state official for that matter, to act as an immigration enforcement official, said Michele Caldera, a clinical professor of immigration law at the University of Connecticut School of Law.
