Austin, Texas-based DMX Inc., which provides in-store music to retailers, health clubs and other businesses, was in an ongoing legal battle with a client. The client wanted to break its long-term agreement with DMX, recalls Marc B. Collier, a partner in Fulbright & Jaworski in Austin who handles some litigation for DMX.

The logical solution, Collier says, was for the companies to settle the litigation and part ways. But Benjamin M. Hanson, DMX’s general counsel, brainstormed another solution where each company’s business leaders hashed out a compromise without lawyers present.
