More than 85% of in-house counsel are testing out alternative billing arrangements, according to a recent survey sponsored by Chicago law firm Butler Rubin Saltarelli & Boyd. Sixty percent of the 162 in-house counsel who responded to the online survey on managing litigation expenses also reported success with fee arrangements other than the traditional hourly billing method. The survey revealed varying reasons why in-house lawyers are keen on alternative fee arrangements: 39% liked the cost predictability of alternative fees while 33% used alternative methods as a way to share risk with their outside counsel. “We won’t eliminate hourly fees entirely but these results show that the market may yet get to a point where there are a variety of mechanisms to control costs and likely different ones for different matters,” said Butler Rubin partner James A. Morsch. Butler Rubin, sponsored the survey to test the litigation boutique’s observation that inside counsel are increasingly open to alternative fee agreements, said partner Patrick Lamb.
