Larry Gooch’s life is on on the line. So when Gooch heard his lawyer, Thomas Heslep, eliciting damning testimony about him from a police officer during his trial in the U.S. District Court for the District of Columbia last week, he didn’t keep quiet. Gooch, who faces dozens of charges, including drug dealing and a double homicide, sent Judge Rosemary Collyer a note asking for a new lawyer. Gooch’s attorneys haven’t exactly objected, either. Rather, his team of lawyers — which also includes Jensen Barber and James Connell — is asking Collyer to declare a mistrial, or at least appoint an outside lawyer to look into Gooch’s allegation that his lawyer screwed up. But the government thinks this request is spurious: “You can’t file a motion for a mistrial claiming ineffective assistance of counsel against yourself,” prosecutors said in court, according to documents. In response, Gooch’s counsel argue they are not the ones making the allegation — their client is.
