TOSHIBA GETS NEW TRADE SECRETS TRIAL SAN JOSE � A Santa Clara County Superior Court judge has agreed to grant Toshiba Corp. a new trial in its defense against trade secrets theft charges by Lexar Media Inc. The ruling comes after Lexar was awarded $465.4 million in October. Judge Jack Komar agreed with Toshiba attorneys who had asked for a new trial on the grounds that the trade secret allegations were not supported by the evidence and that the award was excessive. “The defendants are entitled to a new trial on the economic and monetary awards for misappropriation of trade secrets and breach of fiduciary duty, as well as the award of punitive damages,” Komar wrote in an order filed Friday, adding that the new trial may be limited to these issues and their related sub-issues. At the first trial Lexar had asked for more than $1 billion in damages. Fremont-based Lexar, which manufactures flash-memory cards, claimed that Toshiba shared Lexar’s confidential business plans with its competitor SanDisk Corp. Toshiba had invested in Lexar and had had a seat on its board. The case is Lexar Media v. Toshiba, 1-02-CV-812458. � Julie O’Shea New Partners REED SMITH ELEVATES 5 IN CALIFORNIA Reed Smith announced Monday that it has promoted 27 lawyers to partner effective Jan. 1, including five new partners in California. Daniel Cody, 36, who practices in the firm’s health care group, earned his J.D. in 1998 at the College of William and Mary School of Law. He is an associate in the firm’s San Francisco office. Dale Freeman, 38, a corporate associate in the firm’s San Francisco office, earned his J.D. in 1997 from Boalt Hall School of Law. Garth Osterman, 35, a corporate associate in the firm’s San Francisco office, earned his J.D. in 1996 from the University of San Francisco School of Law. Todd Toral, who will be 38 on Wednesday, is of counsel in the firm’s San Francisco office, practicing in the area of commercial restructuring and bankruptcy. He earned his J.D. in 1998 from the University of San Francisco School of Law. Junga Park Kim, 34, an associate in the firm’s Los Angeles office, earned a J.D. in 1998 from Pepperdine University School of Law. Kim works on product liability cases. Reed Smith is a firm of 881 lawyers worldwide with offices in Oakland, San Francisco and Los Angeles. Last year, there were two partner promotions in the firm’s California offices. &# 151 Marie-Anne Hogarth LUCE FORWARD NAMES FIVE NEW PARTNERS Luce, Forward, Hamilton & Scripps has promoted five associates to its partner class, effective Jan. 1.This year’s numbers are on par with last year’s five partner promotions. Three of the new partners are in the firm’s San Diego office, one in Carmel Valley/Del Mar and one in Los Angeles. In San Diego, the firm promoted Joseph Foss, 32, an insurance litigator who received his J.D. from Pepperdine University School of Law in 1998; Andrea Kimball, 33, who practices business and commercial litigation and received her J.D. from the University of Toledo in 1997; and Jaikaran Singh, 33, a trial lawyer who received a J.D. from the University of Iowa College of Law in 1998. In Los Angeles, the firm promoted Suzanne Badawi, an insurance and business litigator, 34, who received her J.D. from Syracuse University School of Law in 1996.
