The cases didn’t satisfy Senate Judiciary Chairman Arlen Specter (R-Pa.), but the litigation matters Harriet Miers disclosed in her questionnaire last week offer a slightly broader glimpse into the Supreme Court nominee’s legal background. In the 1980s, for instance, she was co-counsel to Pioneer Nuclear, a Texas-based oil and gas exploration company that had come under attack for antitrust violations. The case settled without the company making any payment. Miers also served as co-counsel to Fannie Mae in a mortgage-lending case she argued before the U.S. Court of Appeals for the 5th Circuit in 1985. (She won most of the claims in favor of her client.) And Miers was lead counsel to Interstate Fire & Casualty Co., which was fighting insurance claims by a Catholic church that had been hit with a $101.6 million verdict for sexual abuse and child molestation. That case also settled. Miers also included one of the three cases on which she petitioned the Supreme Court for a writ of certiorari: the 1975 case of Alex Popeko, who had been convicted on two counts of transporting counterfeit securities. The Court denied the petition.
