The modest federal courthouse in Charlottesville, Va., is now home to not just one, but two short-list potential Supreme Court nominees. Fifth Circuit Appeals Court Judge Edith Brown Clement, whose New Orleans courthouse was damaged by Hurricane Katrina, has set up shop in Charlottesville, where 4th Circuit Judge J. Harvie Wilkinson III is also in residence. Clement has family in the area. She could not be reached for comment, but Wilkinson said that soon after the hurricane she called him up and asked if there was room available. “I told her, �You bet there is, and we’d be mighty glad to have you here.’” A law passed in the wake of Katrina allows appeals judges to sit outside their circuits in an emergency. So Clement and her clerks and staff migrated north, where she is occupying a visiting judge’s chambers in the building.
