Click here for the full text of this decision FACTS:Susan and John Roberts filed a medical malpractice suit against Northwest Texas Healthcare System Inc. and Harvey Ross Shadbolt. The plaintiffs filed a timely expert report, as required by the med-mal statute. The defendants filed a motion to dismiss the report as inadequate. The Robertses responded by asking for a 30-day grace period, based on their assertion that they mistakenly believed the report satisfied the statute. The trial court granted the request. The defendants filed for a writ of mandamus, saying the trial court should not have granted the request for grace period and should have granted the defendants’ motion to dismiss. HOLDING:Writ conditionally granted. The court finds the reports related to Shadbolt are facially insufficient because they omit or state mere conclusions about the standard of care, how it was breached or how such a breached caused the injuries. The court also finds the reports related to Northwest are insufficient for the same reason. Consequently, the trial court was not authorized by the med-mal statute to grant a grace period, and abused its discretion in doing so.
