To the editor: Tony Mauro’s summary in the April 25 Legal Times of adverse comments on David Garrow’s article about Justice Harry Blackmun gives Garrow something of a free pass and in the process inadvertently slights Mark Tushnet — and also Justice Blackmun, for whom I clerked during his last year as an 8th Circuit judge and his first year as a justice ["Blackmun Article Triggers Backlash," Page 8]. Mauro quotes Garrow’s comment that “none of the negative reaction wants to discuss the specific evidence that’s so copiously detailed in the piece.” The article notes professor Tushnet’s point that much of what Garrow cites is “perfectly standard law-clerk communication to a justice,” but overlooks that Tushnet’s posting, in fact, took up Garrow’s main specific points. Tushnet argued persuasively that Garrow portrayed Justice Blackmun and the clerks in the most negative light when benign readings were not only plausible but also more reasonable. Mauro’s article leaves the impression that Garrow’s bill of particulars against Justice Blackmun stands unrebutted when, in fact, it has been well-debunked. Daniel B.
