Click here for the full text of this decision FACTS:Shawna Beller was charged with third- degree felony theft. She filed a motion to suppress her written confession. The trial court denied the motion but did not enter findings of fact and conclusions of law. A jury convicted Beller as charged. On appeal, Beller argues that the trial court erred by not entering the findings of fact and conclusions of law. She asks this court to abate the appeal and order the trial court to make such findings and conclusions. HOLDING:Appeal abated. Under Texas Code of Criminal Procedure Art. 38.22, a trial court is required to enter written findings of fact and conclusions of law in ruling on the voluntariness of a defendant’s statement. The requirement is mandatory, regardless of whether or not the defendant objects. The trial court thus erred when it failed to make the required findings and conclusions. The court orders the trial court to make appropriate findings and conclusions within 30 days and deliver them to the trial court clerk, who will, in turn, supplement the appellate record. Beller will then be given the opportunity to amend or supplement her appellate brief. OPINION:Per curiam. DISSENT:Gray, C.J. “Because the majority now chooses to run over me by not allowing an adequate time for me to prepare a full and proper dissent, I will issue my dissent on a later date. The majority gave no notice to me that this order would issue today.”
