Regarding your recent Bar-O-Meter [Oct. 22] saying that my timing was bad working for Secretary of State Shelley just before the newspapers descended on him, there is some truth, even humor in your observation. But I did want to make a couple of points. The timing was dictated by two urgent matters: the statewide recall election and the controversy over the failure of electronic voting system manufacturers to implement a voter-verified paper trail or other minimal safeguards to ensure that votes are counted as cast. The latter issue is critical to the upcoming presidential election, and the secretary has been a national leader in mandating electronic voting safeguardsthat are stilllacking in most of the country. It’s not always possible to “time” the emergence of major public issues or political controversies. And, as much as I would like to be viewed as a good guy, I’m not sure it’s in anyone’s best interest to encourage lawyers to worry about “timing” when important rights are a stake.
