Updating a news story that appeared in the summer issue of IP magazine (“Arnold Gets Tough”), California Gov. Arnold Schwarzenegger has settled a publicity-rights lawsuit against an Ohio company that sells bobblehead versions of political personalities, including one that depicts the action-figure actor turned politician. Lawyers for Schwarzenegger earlier claimed that his Hollywood-related publicity rights had been violated after Ohio Discount Merchandise Inc. began selling a bobblehead doll of a grinning Schwarzenegger brandishing an automatic weapon while wearing a business suit. The settlement allows the company to continue selling a Schwarzenegger doll, but without the rifle. The actor-politician’s movie production company said in the original lawsuit, filed in Los Angeles County Superior Court, that it does not permit Schwarzenegger’s “name, photograph, likeness or voice” to be used on unauthorized commercial products. The Ohio bobblehead makers had argued that the First Amendment protected their right to produce dolls that parodied political figures.
