Last week, the Bankruptcy Update column reported on a recent decision of the 1st U.S. Circuit Court of Appeals in Eagle Insurance Co. v. BankVest Capital Corp.(In re BankVest Capital Corp.) , (1st Cir. 2004), along with the conflicting decision of In re Claremont Acquisition Corp. , (9th Cir. 1997).
