After making several furtive movements defendant was physically restrained; a gun was removed from his jacket pocket. Upon arrest, defendant asked the officer if he would like another gun. A second gun was recovered from the jacket. During transportation to the police station, defendant made a statement concerning another gun. An officer asked about the gun’s location. Defendant consented to a search of his apartment by police, who recovered a third gun. After a Dunaway/Mapp/Huntley hearing, the court denied suppression. It found that the police had reasonable suspicion to stop and detain defendant and that although Miranda warnings had not been given, defendant’s voluntary and spontaneous statements as to the existence of weapons permitted police to inquire as to the location of weapons for safety reasons.
