Click here for the full text of this decision FACTS:Antonio Torres was indicted for three counts of bribery in the 103rd district court; the presiding judge recused himself at Torres’ request. The case was then assigned to a judge from the 5th Administrative Judicial Region. The region’s administrative judge, Judge Darrell Hester, requested that Judge David Peeples, the presiding judge of the 4th Administrative Judicial Region, to assign a judge. Peeples assigned Judge Mark Luitjen of the 144th District to preside. Torres filed a writ of mandamus with this court, asking this court to direct Hester to first determine whether there was a “need” to assign a judge from outside the 5th Region. Torres also filed a motion for a stay of the proceedings in the 103rd Court. HOLDING:Dismissed for lack of jurisdiction. The court joins the 7th Court of Appeals’ ruling in In re Hettler, 110 S.W.3d 152 (Tex.App. Amarillo 2003, orig. proceeding), to hold that an appeals court lacks jurisdiction to issue a writ of mandamus against a presiding administrative judge of a judicial district. The court also notes how the Hettler pointed out that regional administrative judges are appointed by the governor with the advice and consent of the senate and have different qualifications and duties than district judges.
