Huawei Technologies Co., Ltd., which makes the routers that direct Internet traffic, has had to do some tricky navigating of its own recently. The Chinese company has been engaged in an ongoing legal battle with software giant Cisco Systems, Inc. In June, a federal district judge in Texas barred Huawei from using or distributing any operating system that either contains or is derived from a specific Cisco source code module. In his preliminary injunction, Judge T. John Ward, who sits in Marshall, Texas, ruled in favor of several, but not all, of Cisco’s complaints. Cisco filed suit against Huawei in January, contending that in producing its Quidway routers, Huawei illegally copied source code, whole portions of Cisco’s user manuals, and other Cisco products. Huawei withdrew its routers from the U.S. market shortly after Cisco filed the suit. The company admitted that one of its source code modules matched Cisco’s, but maintains that the copying was unintentional and that it has stopped using this module in its products. Judge Ward has yet to rule on several patent and trade secret claims that Cisco included in its complaint. A trial on those issues is set for May 2004. For plaintiff Cisco Systems, Inc.
