EMOTIONAL DISTRESS the parents of an 18-month-old who died in his sleep failed to convince a Massachusetts jury that they deserved damages from the hospital that retained their child’s organs for study after performing an autopsy. Donald and Cathleen Macrelli’s son, David, was autopsied at Children’s Hospital in Boston, which returned the body but kept his organs. The Macrellis were not aware of this when they buried him; when they discovered it, they sued the hospital and three of its doctors for emotional distress. The hospital contended that it had been requested to retain the organs by the state medical examiner’s office and therefore was not liable. On June 5, the jury agreed. Macrelli v. Children’s Hospital, No. 99-4183B (Suffolk Co., Mass., Super. Ct.). PLAINTIFFS’ ATTORNEYS: Michael Hugo and Samuel Pollack, Hugo & Pollack, Boston DEFENSE ATTORNEY: William J. Dailey Jr., Sloane & Walsh, Boston
