Intellectual property giant Finnegan, Henderson, Farabow, Garrett & Dunner turned in a solid performance in 2002. In the District, the firm grew by 14 lawyers, and gross revenue rose 9 percent, or nearly $13 million. But a slight increase in the equity ranks and the opening of a new, 40-lawyer office in Reston, Va., kept profitability levels at the IP-only firm flat compared with 2001 figures. Managing partner Christopher Foley also acknowledges that the sluggish business climate is taking a toll. “We’re holding steady, but we would like to see an economic rebound,” he says. Still, Finnegan partners are among the best-paid in the District, with average profits per partner of $755,000 last year. In part, says Foley, that’s because the firm’s IP lawyers “can command billing rates that are maybe higher than litigators in other specialty areas.” Also, the firm is able to bill work by nonlawyer technical specialists, says Foley, which helps contribute to the bottom line. IP litigation made up about 60 percent of the workload in 2002; patent prosecution accounted for another quarter, with licensing, counseling, trademark prosecution, trade secrets, and copyright work making up the balance. The firm also boasts one of the top appellate practices centered around the U.S. Court of Appeals for the Federal Circuit. Despite the IP-only focus, Foley says Finnegan has remained stable thanks to a careful balance of the firm’s lawyers, who are divided almost evenly among biological/pharmaceutical, chemical, and electrical specialties. The firm’s pharmaceutical lawyers were busy in 2002, representing GlaxoSmithKline in nine patent infringement cases involving the anti-depressant Paxil. They also represented Eli Lilly and Co. in a suit brought by Pfizer Inc. involving patents related to Viagra and to Eli Lilly’s product Cialis. Other cases include representing the L’Oreal Group in a suit against Procter & Gamble’s Clairol over hair dye formulas, and defending the Coca-Cola Co. in a patent case brought by P&G over the composition of Minute Maid orange juice with calcium. In 2002, Finnegan announced it would open its eighth office, in Taipei, Taiwan, to serve China, Taiwan, Hong Kong, and Singapore. The firm also signed a lease in the District with Boston Properties as the anchor tenant of a new building now under construction at 901 New York Ave., N.W., across from the new Convention Center. The office, which the firm will occupy in 2005, will have 250,000 square feet—room for 280 lawyers, or 65 more than now work in the District.
