MEDICAL MALPRACTICE a patient alleging that his doctor negligently performed nasal surgery is not entitled to damages, a Palm Beach, Fla., jury found. Victor Gutierrez and his wife sued surgeon Jeffrey Schottland of Delray Beach, Fla., alleging that the surgery he performed caused a cerebral spinal fluid leak requiring subsequent craniotomy surgery. The plaintiffs alleged that Gutierrez suffers from permanent brain damage. Schottland argued that he was not negligent, and that Gutierrez’s symptoms resulted from his dependence on pain and psychotropic medications. On May 15, a Florida jury found that there was no negligence on the part of Schottland that could have resulted in Gutierrez’s alleged injuries. Gutierrez v.
