Court of Appeals held on June 5. In re Swisher, No. 01-BG-920. C. Crady Swisher, a member of both the West Virginia and D.C. bars, was suspended in West Virginia for failure to satisfy a judgment stemming from a legal-malpractice action. Bar counsel recommended that no reciprocal discipline be imposed for failure to pay the judgment because D.C. did not have a sanction for failure to pay a judgment. The court agreed that discipline substantially different from that imposed in West Virginia was warranted. West Virginia suspended Swisher until the debt was paid, while D.C. imposed a 30-day suspension for Swisher’s failure to cooperate with West Virginia’s disciplinary investigation. The court declined to decide whether failure to pay a judgment could ever be sanctioned based on D.C.’s rule on conduct seriously interfering with the administration of justice.
