LEGAL PROFESSION a district of columbia attorney, who had been suspended in West Virginia for failure to satisfy a judgment, was not subject to reciprocal discipline because D.C. had no disciplinary sanction for failure to pay judgments, the D.C. Court of Appeals held on June 5. In re Swisher, No. 01-BG-920. C. Crady Swisher, a member of both the West Virginia and D.C. bars, was suspended in West Virginia for failure to satisfy a judgment stemming from a legal-malpractice action. Bar counsel recommended that no reciprocal discipline be imposed for failure to pay the judgment because D.C. did not have a sanction for failure to pay a judgment. The court agreed that discipline substantially different from that imposed in West Virginia was warranted. West Virginia suspended Swisher until the debt was paid, while D.C. imposed a 30-day suspension for Swisher’s failure to cooperate with West Virginia’s disciplinary investigation. The court declined to decide whether failure to pay a judgment could ever be sanctioned based on D.C.’s rule on conduct seriously interfering with the administration of justice.
