NEGLIGENT HIRING a mentally retarded man who was left a quadriplegic on a ventilator after being assaulted by an employee of the assisted living facility where he was a resident settled his suit against the facility for $9 million on May 27. Clover House resident Terry Wayne Korman, 49, claimed that the punch by the employee of the Homestead, Fla., facility, owned by Miami-based nonprofit Sunrise Community Inc., knocked him to the ground, fracturing his vertebra. To make matters worse, instead of immediately transferring Korman to nearby Homestead Hospital, Sunrise kept him there for nearly two days, the plaintiff claimed. He was later transferred to South Miami Hospital, where he stayed for eight months. Korman’s family, on his behalf, sued Sunrise for negligent hiring and retention. Before the case was set for trial, Sunrise’s insurance carriers settled for the policy limits. Korman v. Sunrise Community Inc., No. 2002-CA-10806-CA-01 (Miami-Dade Co., Fla., Cir. Ct.).
