CONSUMER PROTECTION a man who sent 875 million unsolicited e-mails was ordered by a Georgia judge on May 7 to pay more than $16 million to an Internet service provider. EarthLink Inc. claimed that Howard Carmack sent out the spam-advertising cable TV descramblers, get-rich-quick schemes and other services-between 2001 and 2003. The Atlanta-based company sued Carmack, alleging Racketeer Influenced and Corrupt Organizations Act and privacy act violations, computer fraud, trespass and other state and federal causes of action. Carmack, who was not present at a default judgment hearing, was ordered to pay $2,734,940 in compensatory damages, which was trebled under RICO and with an equivalent amount added on as punitives.
