DECISIONS DECISIONS CONSTITUTIONAL LAW an employee had no constitutional right to have a Confederate battle flag on his lunchbox in the workplace, the 4th U.S. Circuit Court of Appeals said on May 30. Dixon v. Coburg Dairy Inc., No. 02-1266. Matthew Dixon, a mechanic for Coburg Dairy Inc. and a member of the Sons of Confederate Veterans, placed Confederate battle flags on the lunchbox he brought into the workplace. After a black employee complained, the company offered to buy Dixon a new lunchbox to replace the lunchbox with the flags. Dixon responded, “My heritage is not for sale,” and the company fired him. Dixon sued on both state and federal claims. After the dairy removed the case to federal court, a district court dismissed the action, and Dixon appealed. The court held that Dixon had no right to display the flag on the property of a private employer. It said, “the First Amendment protects citizens only from government or state interference with their rights to free speech.”
