ENVIRONMENTAL LAW a chemical company on May 13 agreed to pay the state of Texas $9.1 million in civil penalties over the next four years for alleged violations from 1994 to 1998 of the Texas Clean Air Act. The alleged violations occurred at the Port Arthur, Texas, plant of Huntsman Petrochemical Corp., and involved unreported emissions of harmful air pollutants such as benzene and other volatile organic compounds, as well as nitrogen oxide and carbon monoxide. Of the penalty, $1.6 million will be waived subject to Huntsman monitoring and reporting air contaminant levels publicly. The penalty is the largest ever paid by a company for violations of the Texas Clean Air Act. Huntsman also must pay $375,000 in attorney fees to the state. State of Texas v.
