Scott Graham’s recent article, “A Lose-Lose Situation,”[May 23] presented a compelling analysis of the monstrous litigation that was Campillo v. Pole. However, to characterize William Fitzgerald as “the only one who comes out not looking like a loser” is completely erroneous. Mr. Fitzgerald and Ms. Pole fought this litigation for 7+ years because of what they felt were false claims. For Mr. Fitzgerald to settle out just prior to the second phase of the trial, and offer testimony, seems to me to be the definition of “loser.” Ms. Pole was not only a professional beacon to Mr. Fitzgerald, but a personal friend. His behavior in this litigation should certainly not be relished. In fact, it is quite indicative of the nasty case as a whole. Instead, Mr. Graham should have highlighted the fact that Ms. Pole, to her credit, took the stand in her defense while being attacked both personally and professionally. If indeed anyone can be identified as a “winner” in this litigation, it is Ms. Pole. It is clear by the jurors’ decision that they felt the same. Joel Smith Los Angeles
