LEGAL PROFESSION an employment law firm defeated a negligence claim over its handling of a whistleblower case before a Texas jury on April 28. Pittman & Fink of Austin, Texas, settled the underlying case for $400,000, billing plaintiff Linda Mercer $378,000 for its services. Mercer sued the firm and partners, Glenda Pittman and Vella Fink, claiming that they spent too much and failed to explain adequately the costs and risks. The defendants contended that Mercer’s case was complicated and required a vigorous defense. Additionally, they argued that Mercer knew the costs and risks, and that she had paid her legal bills regularly and without question. Referring attorney Donald Bishop of Dallas settled a third-party complaint against him by signing over his referral fee to Mercer. Mercer v. Pittman & Fink, No. GN102172 (Travis Co., Texas, Dist.
