I read with interest your article, “Memo airs AG’s angst over the ADA,”April 9, 2003. While you make much of a memo written about a case the AG withdrew from the Supreme Court ( California Medical Board v. Hason), and characterize our case handling as involving “hiccups,” I prefer to judge our efforts by our results. This term, the court has agreed to hear seven of our cases on the merits. We withdrew the Hason case, and have prevailed in three of the cases so far decided by the court. We are awaiting opinions in two more, and the seventh will be argued in late April. Our lawyers have also authored amicusbriefs on behalf of the states in seven more cases this term. So far, the positions we have supported as amicushave prevailed in three of them. The other four are not yet decided. We believe it’s results and our advocacy that count when assessing our work before the high court, not the internal debate and wrangling that contributes to our final product.
