Longtime Walnut Creek criminal defense attorney Barry Blackie Burak filed a writ of mandate on Dec. 19 to force the commissioner to change the wording. The phrases may mislead voters, he argued.

Golub primarily presides over traffic and small claims cases, Burak said. A voter who is unfamiliar with the courts may mistakenly believe that Golub presided over felony jury trials or major civil cases.
