Surrogate Malave-GonzalezESTATE OF ALPHONSE MAGLIO, Deceased (11-1183/H) — The executor, one of the decedent’s daughters, seeks to distribute the remaining proceeds of causes of action settled in the Supreme Court, New York County (Mendez, J.), which are being held in her attorneys’ escrow account. The causes of action arose from the decedent’s exposure to asbestos. The supreme court order, inter alia, directed the payment of counsel fees, disbursements and a subrogation claim.The decedent died on February 4, 2011. The decedent’s distributees are the petitioner and two other children, all of whom are equal beneficiaries under his will. Similar applications were approved previously.
