The 1st U.S. Circuit Court of Appeals has upheld a lower court’s nearly $49 million judgment for the Federal Trade Commission, giving the agency a total win in a multi-pronged deceptive advertising case against an infomercial company.

On Oct. 21 in Federal Trade Commission v. Direct Marketing Concepts Inc., a unanimous panel decision upheld two August 2009 disgorgement orders by Judge George O’Toole of the District of Massachusetts. O’Toole ordered most of the defendants to collectively disgorge more than $48 million.
