Handing Wyeth a setback in a patent infringement suit over its antidepressant Effexor XR, a federal judge says the pharmaceutical company can't claim that its out-of-court settlements in earlier cases are confidential. Wyeth claimed that if the agreements were produced in discovery, information about the royalty its competitors will be paying "will give defendants an unfair" pricing advantage. But the judge said Wyeth's "third-party confidentiality concerns do not outweigh legitimate grounds to compel production."

Magistrate Judge Douglas Arpert in Trenton, N.J., held Tuesday that the discovery request was reasonable and relevant to defense of the suit, Wyeth v. Orgenus Pharma Inc., 09-cv-03235.
