One of the most important intellectual property cases on the 3rd Circuit’s docket will be argued today as a three-judge panel considers whether the manufacturer of Thomas’ brand English muffins was entitled to an injunction that barred one of its top-level executives from taking a new job with a competitor.

The fast-tracked appeal in Bimbo Bakeries USA Inc. v. Botticella will review a February ruling in which U.S. District Judge R. Barclay Surrick enjoined Chris Botticella, a former senior vice president at Bimbo, from starting to work for Hostess Inc.
