An Ohio appeals court reversed and remanded a nearly $1 million jury award in a medical malpractice case after concluding the trial court’s evidentiary errors and faulty jury instruction prejudiced the defense.

In a Sept. 1 opinion, authored by Judge Pierre H. Bergeron for the First District Court of Appeals of Ohio, the court concluded a new trial was warranted due to several errors made by the plaintiff’s counsel against the defendants Dr. Abubakar Durrani and the Center for Advanced Spine Technologies Inc. (CAST).
