ADDING INSULTS TO INJURY CASES  – If it’s human nature to seek comfort in the familiar during tumultuous times, plaintiffs lawyers fighting with each other in multidistrict litigation is the legal industry equivalent of a nice warm Snuggie right about now. As Amanda Bronstad reports, a battle for leadership is threatening to unravel a confidential settlement in the MDL over alleged privacy violations by TikTok Inc. The group of plaintiffs attorneys who negotiated the settlement is now at loggerheads with another group of plaintiffs lawyers who were not involved in the talks. Bickering among plaintiffs counsel in these types of cases is a tale as old as time and a song as old as rhyme. But what’s unusual in this particular instance is that even defense counsel has joined the fun, with TikTok’s lawyers chiming in to note that the non-settling attorneys “needlessly multiplied the litigation with overaggressive and excessive pleadings, emergency motions, and attempts to sabotage the efforts of other parties to resolve the litigation.”
