Last week, the Fifth Circuit declined to rehear Fisher v. University of Texas at Austin, though the Supreme Court had remanded the case for consideration last term. The circuit court's decision means Fisher may make its way back to SCOTUS for a second appearance. But if Fisher Round Two doesn't appeal to the justices, they may well have two new cases to choose from instead.
