TUPE regulations: Waiting on the front line
Views are divided on the likely effect of the financial crisis on litigation. However, for employment lawyers at least, these are interesting times, as the competing interests of protecting employment rights and promoting the rescue of businesses look set to do battle in the courts.The insolvency provisions of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE 2006) were introduced with the promise that they would facilitate the so-called 'rescue culture' - making insolvent employers more attractive to prospective purchasers by relieving them of onerous TUPE liabilities.
