On 2 October, 2000, the Human Rights Act 1998 came into force across the UK. Scotland, however, already had some experience of the effect of the provisions of the act and the European Convention on Human Rights as a result of the Scotland Act 1998.

Under the Scotland Act, the Lord Advocate was required to comply with the convention and hence there was some growing experience within the Scottish criminal justice system in terms of the challenges brought by way of ‘devolution issues’.
