  • Govt to consult on contingency fees and limiting 'loser pays' model

    The Government is set to consult on the introduction of contingency fees in UK litigation alongside other key recommendations proposed by Lord Justice Jackson to reform civil litigation costs. Parliamentary under secretary of state for justice Jonathan Djanogly announced today (26 July) that the Ministry of Justice will consult on recommendations published in January in Jackson's high-profile report 'Review of Civil Litigation Costs'. The consultation will launch in the autumn and will seek views on whether lawyers should be permitted to enter into damages-based agreements (DBAs) or 'contingency fees' in litigation. If introduced, lawyers will be allowed for the first time to take a slice of their client's damages, after Jackson acknowledged that the "arguments in favour of contingency fees... outweigh the arguments against".

  • Insurer loses legal battle with Law Society

    A Court of Appeal judgment is set to have major implications for insurers seeking access to confidential documents from solicitors that could enable them to refuse indemnity, writes Post. In Quinn Direct Insurance v The Law Society, Quinn had appealed against an earlier High Court decision to refuse the company access to confidential documents relating to a firm of solicitors that was being investigated by the Law Society. In 2007 the Law Society took possession of files and documents relating to the firm as part of a large-scale fraud investigation. Quinn had provided the firm with professional indemnity insurance and was its primary insurer.

  • Hill Dicks scores court victory for Wayne Rooney in contract dispute

    Hill Dickinson has helped Wayne Rooney to a court victory in the footballer's dispute with his former agents over commission payments. Rooney signed an eight-year image rights agreement with Proactive Sports Management in 2003 when he was just 17 that entitled the agency to 20% of all of his sponsorship contracts. He split from the company in 2008, after which he was represented solely by former Proactive employee Paul Stretford, leading the agency to claim £8.1m in unpaid commission, a sum which was later revised to £4.5m.

  • RPC recruits Clydes partner for disputes team

    Reynolds Porter Chamberlain (RPC) has recruited Clyde & Co's head of dispute resolution and co-head of international arbitration, Jonathan Wood, for its commercial disputes practice. Wood, who joined Clydes in 1983, making partner in 1986, joined RPC as a consultant on 28 June and will work alongside eight partners in commercial disputes.

    Seven years have passed since Russia began the campaign against Yukos Oil Company that led to the re-nationalisation of a business controlling more than 3% of world oil production, comparable in scale to Chevron. The dispossessed owners call it the biggest political expropriation in history. The fall of Yukos has generated history's biggest arbitrations - and by far the largest human rights claim ever - with stakes as high as $100bn (£66bn). The director of the majority shareholder group, Timothy Osborne, vowed a "lifetime of litigation" against those responsible, and he is well on his way.

Hong Kong-qualified lawyer Simon Powell, who joined Latham's Hong Kong office last week, is regarded as one of the region's top insolvency and litigation specialists. He also advises financial institutions and companies in the region on securities and competition regulation, as well as commercial litigation.

    Cuatrecasas Goncalves Pereira has opened a new office in Malaga through a merger with local boutique Romero & Robles. Founding partners Francisco Romero and Jorge Robles will head up the new base for Cuatrecasas, with Romero taking the managing partner role. Robles previously worked at Cuatrecasas between 1999 and 2006 before setting up the boutique along with Romero after a short stint at law firm RL in Malaga in 2007.

  • Dechert litigation partner takes senior legal role at Microsoft

    David Howard, the co-chair of the white-collar and securities litigation group at Dechert, is leaving the firm to become corporate vice president and deputy general counsel in charge of litigation at Microsoft, reports The Am Law Daily. Howard will move to Microsoft in early August, and will report directly to the company's general counsel, Brad Smith, a former partner at US firm Covington & Burling.
